Term and Renewal of Trademark Protection in China

It is crucial to understand the protection period and renewal regulations for Chinese trademarks applied for by Singaporean companies.

Protection period:

The protection period for Chinese trademarks is 10 years, calculated from the date of approval and registration. During this 10-year period, the trademark owner has the exclusive right to use the trademark on specific goods or services.

Renewal regulations:

The trademark owner may apply for renewal within 12 months before the expiration of the trademark protection period. The validity period of each renewal is 10 years. If an application for renewal is submitted within 6 months after the expiration of the protection period, additional late fees will be charged. If no renewal application is submitted within 6 months after the expiration of the protection period, the trademark will be cancelled.

Singaporean companies should closely monitor the protection period of their Chinese trademarks and promptly handle renewal procedures to ensure the continued validity and protection of their trademarks.
